Warranty Policy

Effective Date: 16 October 2022

At OEM Spare Parts, we are committed to providing high-quality automotive spare parts, dependable replacement components and professional customer service. We understand that purchasing an engine, gearbox, transmission or other essential automotive component is an important investment.

Our Warranty Policy is designed to provide customers with clear information about product warranty coverage, warranty claims, replacement procedures and their rights under South African consumer protection legislation.

We aim to handle all warranty-related enquiries fairly, transparently and efficiently.

1. Our Warranty Commitment

OEM Spare Parts is dedicated to supplying reliable automotive replacement components that meet the specifications and conditions described at the time of purchase.

Our warranty commitments focus on:

  • Product Quality: Supplying automotive components that meet applicable quality standards.

  • Customer Protection: Respecting customers' statutory warranty rights.

  • Transparent Coverage: Clearly communicating applicable warranty periods and conditions.

  • Professional Support: Assisting customers with product-related concerns and warranty claims.

  • Fair Resolution: Providing appropriate remedies for qualifying defective products.

We are committed to building long-term customer relationships through dependable products and responsible after-sales support.

2. Warranty Coverage

OEM Spare Parts supplies a range of automotive replacement parts, including:

  • Complete petrol and diesel engine assemblies

  • Engine long blocks and short blocks

  • Cylinder heads and internal engine components

  • Automatic and manual gearboxes

  • Transmission assemblies and components

  • Steering racks and steering components

  • Suspension and drivetrain components

  • Other automotive replacement parts

Warranty coverage applies according to the statutory protections available to the customer and any additional warranty expressly offered with the product.

The applicable additional warranty period, where provided, will be specified in the product listing, quotation, invoice or accompanying warranty documentation.

3. Statutory 6-Month Warranty

Under Sections 55 and 56 of the South African Consumer Protection Act, qualifying goods are protected by an implied warranty of quality for 6 months from the date of delivery.

Where these provisions apply, goods must meet applicable standards of quality, safety, durability and fitness for their intended purpose.

If a product fails to meet these standards within the statutory period, the customer may return it at the supplier's risk and expense and elect one of the remedies provided by law:

  • Repair of the defective product

  • Replacement of the defective product

  • Refund of the purchase price

The statutory warranty operates independently of any additional supplier or manufacturer warranty.

Nothing in this policy limits or excludes applicable consumer rights.

4. Additional Product Warranties

Certain automotive components may be supplied with an additional warranty beyond the statutory protection period.

Where an additional warranty is offered, the applicable duration and coverage will be stated in the relevant product documentation.

Additional warranty arrangements may cover specified defects in materials, workmanship or mechanical components, subject to their lawful terms.

Any additional warranty offered by OEM Spare Parts does not replace or reduce statutory consumer protection rights.

5. Engine Assembly Warranty

Our engine warranty provisions apply to eligible petrol and diesel engine assemblies, including complete engines, long blocks and short blocks.

Customers are encouraged to ensure that engines are installed by suitably qualified automotive technicians.

Appropriate installation procedures may include:

  • Verifying engine compatibility and specifications.

  • Inspecting the engine before installation.

  • Using suitable engine oil and lubricants.

  • Checking cooling and lubrication systems.

  • Inspecting related components before operation.

  • Following applicable manufacturer installation procedures.

Where an engine develops a suspected defect, customers should discontinue operation when continued use could cause further damage and contact our support team.

Warranty claims will be assessed according to the reported defect, the applicable warranty and statutory consumer rights.

6. Gearbox and Transmission Warranty

Warranty provisions for eligible manual and automatic gearboxes include defects covered by applicable statutory or additional warranty arrangements.

Customers should ensure that transmission assemblies are installed correctly and filled with suitable transmission fluids.

We recommend professional inspection of associated drivetrain components before installation.

Where a gearbox or transmission develops a suspected defect, customers should report the issue promptly.

Any warranty assessment will consider the applicable coverage, reported fault and relevant technical findings.

7. Steering Rack and Suspension Component Warranty

Warranty coverage for eligible steering racks, suspension components and related automotive parts is determined by the applicable statutory rights and any additional product warranty.

Customers should ensure that components are correctly installed and that associated vehicle systems are inspected where necessary.

Damage caused directly by incorrect installation, misuse or unauthorised modifications may fall outside additional voluntary warranty coverage, where legally permitted.

Qualifying statutory claims will be handled in accordance with applicable consumer protection legislation.

8. New, Used and Reconditioned Parts

OEM Spare Parts may supply new, used, refurbished or reconditioned automotive components.

The condition of each product should be clearly identified in its listing or sales documentation.

New Components: Covered by applicable statutory protections and any additional warranty offered.

Used Components: Covered by applicable statutory consumer rights, taking into account the disclosed condition, age and reasonable expectations of the goods.

Refurbished or Reconditioned Components: Covered by applicable statutory protections and any additional warranty expressly provided.

Any known defects or material limitations will be disclosed where required by law.

The sale of used or reconditioned products does not automatically remove statutory consumer protection.

9. Warranty Exclusions

Additional voluntary warranties may exclude damage directly resulting from:

  • Improper or negligent installation.

  • Incorrect fluids or lubricants.

  • Vehicle overheating caused by unrelated faults.

  • Misuse or abnormal operating conditions.

  • Unauthorised modifications.

  • Accidental damage after delivery.

  • Negligent maintenance.

  • Continued operation after a known serious mechanical fault.

  • External damage unrelated to a covered product defect.

These exclusions apply only where lawful and do not automatically invalidate statutory warranty rights.

Each claim will be assessed according to its circumstances and applicable legal requirements.

10. Professional Installation and Maintenance

We recommend professional installation of major automotive components to support reliable performance and safe operation.

Customers and installers should follow appropriate technical procedures and maintenance requirements.

Where relevant, installation records or diagnostic reports may assist in identifying the cause of a reported mechanical fault.

However, the absence of a particular installation document does not automatically remove statutory consumer rights.

11. How to Submit a Warranty Claim

Customers experiencing a suspected product defect should follow the steps below.

Step 1 – Contact Customer Support

Contact OEM Spare Parts through the official contact details published on our website.

Step 2 – Provide Purchase Information

Supply the order number, invoice or other reasonable proof of purchase.

Step 3 – Describe the Reported Fault

Provide a clear explanation of the problem, including when the issue occurred.

Step 4 – Submit Supporting Information

Where relevant, provide photographs, diagnostic findings or other reasonable technical information.

Step 5 – Receive Claim Instructions

Our support team will explain the applicable inspection or return procedure.

Step 6 – Warranty Resolution

Following assessment, an appropriate repair, replacement, refund or other lawful resolution will be arranged.

12. Warranty Inspections and Assessments

Some warranty claims may require inspection to determine the cause of the reported fault.

Where appropriate, OEM Spare Parts may arrange or request a technical assessment.

Customers will be informed of the relevant procedure and any lawful charges before proceeding.

Where the Consumer Protection Act requires the supplier to accept returned defective goods at its own risk and expense, those statutory obligations will be respected.

Customers will not be required to waive their statutory rights as a condition of submitting a warranty claim.

13. Warranty Repairs and Replacements

Where a qualifying warranty claim is accepted, the appropriate remedy will be provided in accordance with the applicable warranty and legislation.

Under Section 56 of the Consumer Protection Act, qualifying customers may elect repair, replacement or refund within the statutory warranty period.

Where goods are repaired under the applicable statutory provisions and the same or a further defect arises within three months after repair, the customer may be entitled to replacement or refund as provided by law.

Additional voluntary warranties will be administered according to their stated terms, without reducing statutory protections.

14. Warranty Return Shipping Costs

Return transportation arrangements depend on the nature of the warranty claim.

Qualifying Statutory Defects: OEM Spare Parts will bear the applicable return risk and expense where required by the Consumer Protection Act.

Additional Voluntary Warranty Claims: Shipping arrangements will follow the applicable warranty terms, subject to legal requirements.

Incorrectly Supplied Products: Where OEM Spare Parts supplied the wrong product, reasonable return shipping costs will be covered by OEM Spare Parts.

Large mechanical assemblies may require specialised freight arrangements.

15. Replacement Product Availability

Where a replacement is an appropriate remedy, availability will be confirmed before arrangements are finalised.

If an identical replacement is unavailable, customers may be offered an alternative product.

Customers will not be required to accept an alternative product instead of a statutory refund where they are legally entitled to choose a refund.

16. Warranty Claims Without Original Packaging

Customers are encouraged to retain product packaging and purchase documentation where practical.

However, the absence of original packaging does not automatically invalidate statutory warranty rights.

Products should be packaged securely when returned to reduce the risk of transportation damage.

17. Warranty Transferability

Any additional voluntary warranty transfer rights will be governed by the terms expressly provided with the product.

Statutory consumer rights will be determined according to applicable South African legislation.

Customers may contact our support team for clarification regarding warranty coverage on a specific product.

18. Customer Responsibilities

To assist with warranty claims and support reliable product performance, customers are encouraged to:

  • Verify product compatibility before installation.

  • Follow appropriate installation procedures.

  • Maintain vehicles according to relevant manufacturer recommendations.

  • Use suitable oils, lubricants and replacement components.

  • Report suspected defects promptly.

  • Avoid continued operation where serious mechanical damage may occur.

  • Retain reasonable proof of purchase.

These recommendations do not impose additional restrictions on statutory consumer rights.

19. Warranty Disputes and Customer Complaints

OEM Spare Parts is committed to resolving warranty concerns fairly and professionally.

Customers who disagree with a warranty assessment may request a review through our customer support team.

Where a dispute cannot be resolved directly, customers retain the right to approach relevant consumer protection authorities, dispute resolution bodies or competent courts.

20. Limitation of Warranty Liability

Any limitation of liability under an additional voluntary warranty applies only to the extent permitted by South African law.

Nothing in this Warranty Policy excludes or restricts liability, remedies or consumer rights that cannot lawfully be excluded.

Claims involving additional losses or consequential damage will be considered according to the applicable contractual terms and legal requirements.

21. Changes to This Warranty Policy

OEM Spare Parts may update this Warranty Policy to reflect changes in business operations, product offerings or applicable legislation.

Updated policies will be published on our website with the relevant effective date.

Changes will not retrospectively remove warranty rights already acquired under an existing purchase agreement.
